Terms of use for Website and Mobile App

Our website, www.thechinesebuffet.com and The Chinese Buffet Mobile App are made available free of charge. We do not guarantee that the website and app, or any content on them, will always be available or be uninterrupted. We may suspend, withdraw, discontinue or change all or any part of the website or app without notice. We will not be liable to you if for any reason the website or app are unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to the website and app. You are also responsible for ensuring that all persons who access the websites and app through your internet connection are aware of these Terms and that they comply with them.

The Chinese Buffet app requires a smartphone or other mobile device running either the iOS or Android operating systems and, to download the app and to access the latest features, you will need internet access.

The website and app and the content on them are provided for general information purposes only. They are not intended to amount to advice (medical or otherwise) on which you should rely.

You may only use the websites and app for your own domestic, private and non-commercial use.

Your account and password

You will need to register an account with us in order to access certain services available on the website and app. If you register an account, you will be asked to provide certain information (such as your email address) and to create a password, as part of our security procedures.

We use Single Sign On (‘SSO’) for account management. This means that Registered Users can access all of our online services with one set of log in details.

You must be at least 16 years old to register an account, however if you are under the age of 18 years old you must ask for permission from your parent or legal guardian prior to registering an account. There are also certain additional age restrictions for use of certain services listed below:

– You must be 18 or over to order online for delivery or collection

– You must be 18 or over to register a Gift Card

– You must be 16 or over to opt in to receive marketing communications.

To protect your account, keep your password confidential and do not disclose it to any third party. You are responsible for the activity that happens on or through your account. It is best practice not to reuse your account password on third-party applications. If you know or suspect that anyone other than you know your account login details, you must immediately notify us at cs@thechinesebuffet.com

We have the right to disable any accounts and/or passwords, at any time

General Acceptance Terms of Use

You agree not to:

– use the website or app in any way that breaches these terms or any applicable local, national or international law or regulation;

– copy, or otherwise reproduce or re-sell any part of the website or app unless expressly permitted to do so in by us; or

– do any act or thing that might damage, disrupt or otherwise interfere with the operation of the website or app or any equipment, network or software used in operating the website or app

User Generated Content

If it is the case that you supply/upload any content to the website or app – whether it be pictures, text, sound recordings or whatever – the content you supply must comply with the following rules:

– it must not be obscene, abusive, offensive or racist and it must not promote or propose hatred or physical harm against anyone;

– it must not harass or bully another person;

– it must be true and honest so far as you know;

– it must not be defamatory of anyone;

– it must not use the material or content or infringe the rights or privacy of anyone else; for example, you should not use images of well-known characters, footage or music (unless it is your own);

– it must not contain someone else’s personal details or confidential information relating to other people; and

– it must not promote or condone terrorism, violence or illegal behaviour.

We reserve the right to refuse to accept or refuse or cease to use any content supplied by any person that we think contravenes these rules.

Viruses

We do not guarantee that the website or app will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform in order to access the website or app and we recommend that you use your own virus protection software.

You must not misuse the website or app by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the website or app, the server on the website or app are stored, or any server, computer or database connected to the website or app. You must not attack the website or app via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the website or app will cease immediately.

We are the owner or licensee of all intellectual property rights in the website or app and its content,

You are not granted any right to use, and may not use, any of our intellectual property rights other than as set out in these terms. You must not use the website or app (or any part of them or their content) for commercial purposes; however, you may download material from the the website or app solely for non-commercial, personal use by you.

No part of the website or app, including, without limitation, the text, designs, graphics, photographs and images contained in them, may be copied, reproduced, republished, uploaded, re-posted, modified, transmitted or distributed or otherwise used in any way for any non-personal, public or commercial purpose without our prior written consent.

Any communications or materials you send to us through the website or app by electronic mail or other means will be treated as non-proprietary and non-confidential (other than communications in respect of your order if you the website or app to buy products from us). We are free to publish, display, post, distribute and otherwise use any ideas, suggestions, concepts, designs, know-how and other information contained in such communications or material for any purpose, including, but not limited to, developing, manufacturing, advertising and marketing us and our products. You grant us a non-exclusive, transferable, perpetual, royalty-free, worldwide licence to copy, use, reproduce, distribute, display, publish, adapt, prepare derivate works of and/or amend any User Generated Content in any format, including in our services and products for any purpose including in relation to the promotion of our services and products.

We grant to you a non-transferable, non-exclusive, revocable licence to use our app provided that you comply with these terms and the documents referred to in it. We reserve all other rights.

Our liability

We are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you accessed the website or app.

We only supply the website or app for domestic and private use. You agree not to use the website or app, or any content on the website or app, for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Nothing in these terms affects your statutory rights. Advice about your statutory rights is available from your local Citizens’ Advice Bureau or Trading Standards Office.

We assume no responsibility for the content of websites linked to the website or app or included in these terms (including links to any commercial sponsors or partners). Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

We may make changes to these terms from time to time (if, for example, there is a change in the law that means we need to change these Terms). Please check these Terms regularly to ensure that you understand the Terms that apply at the time that you access and use the website or app.

Terms and Conditions for Specific Promotions
TCB DIning Voucher code

– 1 voucher code can be used, subject to two other paying adult. I.e. If you are celebrating 2 birthdays, then 2 unique codes can be used but there must be at least 4 other paying adults.

– Voucher code must be presented along with photo ID such as a driving licence or passport to validate the birthday.

– The registration name must match the ID name.

– One code per customer (mobile number), per year.

– A prior reservation must be made to use the voucher code.

– The code will only become valid after 24 hours from when it is received. I.e. if you receive the code at 1pm on Monday, the code will be valid from 1pm on Tuesday, the following day.

– The code can only be used within 7 days on either side of your birthday. I.e. if your birthday is on 10th of June. The code is valid from 3rd to 17th June.

– Code can be used on any day for EVENING dining at any of TCB Dining restaurants.

– Code cannot be redeemed for monetary value, transferred or used in conjunction with any other promotional offers.

– THE Chinese Buffet Group reserves the rights to refuse, amend or cancel this offer at any time without prior notice.

Privacy Policy

When you visit our website, download and install our mobile app, registered for our SMS promotions or for use one of our other services we will require you to provide us with your Personal Information (as defined below). We want to make sure you feel comfortable about what happens when you browse our website or give us any of your information.

We will always use our best endeavours to make sure your Personal Information is safe and secure. This Privacy Policy explains how we collect, record and use the information you give us. It also explains the choices you can make about the way your information is collected and used. If you provide us with Personal Information, it means you’re giving us your permission to collect, use and transfer it in the ways set out in the Privacy Policy.

What information will be collected about me?

When you visit our Service (in a restaurant, on a mobile device, tablet or desktop) or download and use our app, you may provide us with information personal to you including for example your name, your address, your email address, your mobile phone number and your date of birth, and the other information outlined below (your ‘Personal Information’).

– when using one of our Eat In services, such as table reservation, virtual queue management or completing an order at your table you may be asked to provide basic registration details such as your name, email address and a contact phone number.

– by ordering a takeaway using our online ordering service or by using our app. When you place a takeaway order online we may collect information such as what items you’ve browsed, your favourite and past orders, restaurant locations, if you’ve applied any dietary filters and order values.

– by inputting your payment details – but only in order to complete a transaction.

– by allowing us to collect your physical geolocation through our app (if you have enabled Location Services and agreed to allow us to send you Push messages) or website (e.g. to determine your nearest location for an online order fulfilment).

– by registering to use our in-restaurant WiFi services.

– by signing up for promotions or competitions.

– by corresponding with our Customer Services team by email, in writing, on social media or telephone, in which case we may retain the content of your emails, letters or conversations together with your title, name, email address, the social media username that you’re using, telephone number and our responses.

We may also collect information about your device, including (where available) your IP address, operating system and browser type, the geographical location of your device, how you use our Service, and the date and length of your visit. This information is collected automatically. This information is aggregated and it does not identify you as an individual. We do this to help improve your experience on our Service.

How will we use your Personal Information?

We use your personal information for:

– allowing you to create an account and to use any of the services we provide to account holders

– allowing you to make a table reservation, be alerted to table availability and/or to process and pay for an order at your table

– processing an order for collection or delivery

– contacting you with information about our products, services, news and special offers

– making sure you get the best experience from our Service – depending on what computer or device that you’re using;

– if you’re using the app (and you have given us permission to do so by enabling this on your device), sending you ‘Push’ notifications containing information about our products and services and to provide you with information in the app;

– notifying you about changes or updates to any of our Services;

– carrying out market research and product development;

– meeting legal, regulatory and compliance requirements;

– investigating any complaints about the Service; or

– investigating any safety or security incidents or breaches.

We always want to make sure you’re in control of the information you give us, so we will ensure only the data we really need for the services being used is processed.

Do you share my Personal Information with anyone else?

We only share information with companies that we use to help us better understand and serve you. We never sell or give your Personal Information away to anybody.

Where we share your Personal Information we ensure that they have agreed to be bound by this Privacy Policy and will only use it for the purposes outlined in this Privacy Policy.

We may disclose Personal Information about you to other third parties to comply with applicable laws and regulations. We also have the right to disclose such Personal Information to third parties where there’s been a complaint concerning your use of our Service or where we believe that you haven’t complied with our Privacy Policy.

When you place an order with us for delivery, we will only share the personal information required by our partners to fulfil your order.

Likewise, if you use reserve a table at one of our restaurants or process an order at your table our carefully selected partners will only collect and process the personal information needed to deliver that service.

We engage third party payment processors to process the payment of your online order. These third party processors may store your payment card details, if you want them to, to speed up your transaction time. If you do not want to take advantage of this, please do not select this function.

We may also share Personal Information with third parties for marketing, advertising and strategic development purposes to help us understand customer trends and patterns and to make sure that we are talking to you about the most relevant things. We have Agreements in place that define what third parties can and cannot do with your Personal Information. We also conduct periodic reviews of third parties to ensure compliance. However we will only send marketing to you where you have previously consented to receiving marketing materials from us.

We may also share such details with auditors or legal professionals to obtain professional advice. If we do this, your statutory data protection rights will be preserved.

You should be aware that if we’re requested by the police, a regulatory or government authority in the investigation of suspected illegal activities to provide your Personal Information, then we are entitled do so.

We are using customer insight tools to improve our websites and app. These services may record the screens you visit on our website and some high-level device information. They do not collect personally identifiable information and do not track your browsing habits across apps or websites.

What security measures are in place to protect my “Personal Information”?

The transmission of information via the internet is not completely secure. Although we take steps to protect your information, we can’t guarantee the security of your data transmitted to the Service; any transmission is at your own risk. We have implemented reasonable technical and organisational measures designed to secure your personal information from accidental loss and from unauthorised access, use, alteration or disclosure. We’ll continue to maintain and improve these security measures in line with legal and technological developments.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

The use of our service by under 16s

Our Services are not intended for children and are therefore only to be used by anyone aged 16 or over and those under the age of 16 should have their parents or guardians’ permission. We encourage the supervision of children’s online activities. For example, parental control tools which are available online to help provide a child-friendly online environment. These tools can also prevent children from disclosing their name, address, and other Personal Information online without parental permission. Your child’s privacy is important to us and we are committed to safeguarding children’s Personal Information collected online. Users of our Service may participate in many activities without providing any Personal Information. However, if you’d like to participate in certain interactive features on our Service, we’ll ask you to provide us with certain information, such as your email address and age. We will not send any marketing communications to anyone who has disclosed that they are aged under 16.
